Statement: LHR concerned by ongoing raids
LHR continues to be extremely concerned by the ongoing raids in Johannesburg, Durban and Cape Town as part of Operation Fiela-Reclaim.
We have noted the worrying trend of state leaders turning to “clean up” operations to look for undocumented nationals. We feel that the priority should instead be focusing on a logical and coherent reintegration plan to prevent future violence. These raids and police operations have the unfortunate effect of perpetuating flawed and inaccurate perceptions about foreign nationals. By “raiding” and “sweeping” away this vulnerable group, we essentially dehumanise them which is unacceptable and will likely lead to more violence. These misconceptions are dangerous, not only because they are based on absolutely no evidence but because they spawn a culture of hate and paranoia.
The use of the defence force in immigration enforcement is highly irregular and we call on officials to explain the capacity in which the SANDF is involved in the raids.
That these raids appear to occur at night is especially worrying. The Immigration Act stipulates that searches must be carried out during the day unless expressly authorised for execution at night by a court.
We urge that those involved in the operations be mindful of the Act and especially the Constitution and ensure that they follow the rule of law.
LHR and our partners will be providing legal assistance to those arrested or adversely affected during the course of these raids.
